Official MOOD App End User License Agreement (EULA)

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE DOWNLOADING OR USING THE MOOD APPLICATION. BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE, DO NOT DOWNLOAD OR USE THE APP.
This EULA is a legal agreement between you ("User") and Official Mood App LLC ("Company," "we," "our," or "us"). This EULA governs your use of the MOOD mobile application (the "App") distributed via Apple's App Store.
Acknowledgement
You and we acknowledge that this EULA is concluded between you and Official Mood App LLC only, and not with Apple, Inc. ("Apple"). Official Mood App LLC, not Apple, is solely responsible for the App and its content.
License Grant
Subject to the terms of this EULA, Official Mood App LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial purposes, as permitted by the App Store Terms of Service.
Restrictions
You may not:
Sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App
Modify, translate, adapt, or create derivative works based on the App
Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
Remove any proprietary notices or labels on the App
Use the App for any unlawful purpose or in violation of any applicable laws or regulations
Subscriptions and In-App Purchases
The App offers the following auto-renewable subscription options:
MOOD Monthly $9.99 per month
MOOD Annual $79.00 per year
MOOD Founding Member Annual $39.00 per year (available to qualifying early adopters)
Subscription terms:
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless auto-renewal is turned off at least 24 hours before the end of the current period.
Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current subscription period.
Free trials, where offered, automatically convert to paid subscriptions at the end of the trial period unless cancelled at least 24 hours before the trial ends.
You may manage your subscription and turn off auto-renewal at any time by visiting your Apple ID Account Settings (Settings > [Your Name] > Subscriptions > MOOD).
Cancellation takes effect at the end of the current billing period. You will retain access to premium features until then.
All purchases are final and non-refundable, except as required by applicable law or Apple's refund policy.
Apple is the merchant of record for all In-App Purchases. We do not collect or store your payment card information.
Maintenance and Support
Official Mood App LLC is solely responsible for providing maintenance and support for the App, as required by applicable law and the App Store Terms of Service. Apple has no obligation to provide any maintenance or support for the App.
Warranty
To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE," with all faults and without warranty of any kind. Official Mood App LLC disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
In the event that the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the App.
Product Claims
Official Mood App LLC, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including, but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property
In the event of any third-party claim that the App or your possession and use of the App infringes a third party's intellectual property rights, Official Mood App LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance
You represent and warrant that: (a) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Terms
You must comply with applicable third-party terms of agreement when using the App, including the Apple Media Services Terms and Conditions.
Third-Party Beneficiary
You and Official Mood App LLC acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.
Account Deletion
You may delete your account at any time through the in-app account deletion flow (Settings > Account > Delete Account). Deleting your account does not automatically cancel your subscription; you must cancel your subscription separately through Apple ID Account Settings to stop future charges.
Termination
This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
Privacy
Our collection and use of personal information in connection with the App is described in our Privacy Policy, available at the Privacy Policy link in the app navigation.
Governing Law
This EULA is governed by the laws of the State of Colorado, without regard to its conflict of law provisions.
